These Terms of Service ("Terms") govern your use of the winded.app website and services (the "Service") operated by W&S Technologies Kft. (registered office: 2800 Tatabánya, Mártírok útja 58. 8. em. 3. a., company registration number: 11-09-031841, hereinafter: "Winded", "we", "us", or "our").
1. Acceptance of Terms
By accessing and using winded.app (the 'Service'), you accept and agree to be bound by the terms and provision of this agreement.
If you do not agree to abide by the above, please do not use this service.
2. Use License
Permission is granted to temporarily download one copy of the materials on winded.app for personal, non-commercial transitory viewing only.
This is the grant of a license, not a transfer of title, and under this license you may not:
• modify or copy the materials
• use the materials for any commercial purpose or for any public display
• attempt to reverse engineer any software contained on the website
• remove any copyright or other proprietary notations from the materials

Winded acts as a platform connecting buyers and sellers of kitesurfing equipment.
We do not guarantee the quality, safety, or legality of items listed on our platform.
All transactions are between individual users, and Winded is not a party to these transactions.
Users are responsible for ensuring compliance with local laws and regulations regarding the sale of equipment.
Payment processing is handled by third-party providers, and users agree to their respective terms.
5. Prohibited Uses
You may not use our service:
• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
6. Item Condition Rating System
To ensure transparency and help buyers make informed decisions, all sellers must use our standardized condition rating system when listing items:
Condition Rating Scale
Gear in perfect condition, used a maximum of 1–2 times. No signs of wear, damage, or usage. Feels and looks brand new.
Gear in excellent overall condition. Lightly used, with no scratches, repairs, or visible damage. Not brand new, but extremely well maintained.
Gear in good working condition with visible cosmetic signs of use such as small scratches or minor repairs. Performance remains unaffected and reliable.
Gear shows heavy use over multiple seasons. May have several repairs or visible wear. Still rideable but requires a thorough inspection before first use to ensure safety.
Gear is damaged and in need of significant repair before it can be safely used. If the gear is beyond repair, this must be clearly stated in the item description.
7. Disclaimers
The materials on winded.app are provided on an 'as is' basis. Winded makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Winded does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
Winded is not responsible for the condition, safety, or authenticity of items sold through our platform. Buyers should inspect items thoroughly before purchase and use appropriate safety equipment.
8. Limitations
In no event shall Winded or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on winded.app, even if Winded or a Winded authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
